Our operations are firmly rooted within the provinces of Limpopo and KwaZulu-Natal, though our safari tracking, travel networks, and hunting blocks extend across multiple domestic regions. Any legal disputes, arbitration, or statutory proceedings arising from your interactions with our business will be governed exclusively by the laws of South African courts.
1.3 Scope of Wilderness Operations
Our company provides world-class outdoor adventures, including big game hunting safaris, deep-sea marine fishing charters, and guided photographic wildlife excursions through regions such as the Kruger National Park. Because our services take place in remote, uncontrolled wilderness environments involving wild fauna and heavy marine watercraft, these Terms and Conditions lay down the necessary safety, financial, and legal guardrails to protect both our business and our international clientele.
2. Definitional Framework
2.1 Key Operational Terms
2.1.1 Professional Hunter (PH)
A Professional Hunter refers to the highly trained, legally licensed wildlife expert registered with South African nature conservation authorities who directly oversees, guides, and commands your tracking excursions in the field.
2.1.2 Outfitter
The Outfitter refers to the corporate entity, Deon Burger Safaris, responsible for organizing, licensing, hosting, and executing your travel itineraries, lodge accommodations, and wilderness permits.
2.1.3 Hunting Client / Angler / Guest
The Client, Guest, or Angler refers to any natural person or juristic entity booking a package, stepping aboard our marine charter vessels, entering our hunting blocks, or occupying our luxury safari lodges.
2.1.4 Trophy Fees
Trophy Fees represent the specific standalone costs associated with the successful harvest or wounding of a wild animal, calculated according to the specific rates published in our current species price lists.
2.1.5 Daily Rates
Daily Rates encompass the baseline fees charged per person, per day, covering operational costs such as guiding staff, trackers, skinners, hunting vehicles, laundry, meals, and field preparation.
3. Booking, Deposits, and Payment Protocols
3.1 Reservation Deposits
To securely reserve specific calendar dates for your hunting safari, photographic tour, or deep-sea fishing charter, a formal deposit must be paid directly to Deon Burger Safaris. No booking request is deemed contractually secured or locked into our tracking schedule until the required deposit has cleared into our designated accounts and a formal written booking confirmation has been issued by our office.
3.2 Currency and Invoice Settlements
All transactions, pricing structures, trophy fees, and daily rates are calculated and managed in Euros (EUR). While we accommodate international bank wires, credit card settlements, and approved digital payment channels, clients are solely responsible for covering all associated international transfer fees, currency conversion spreads, and banking transaction surcharges. Final invoices detailing daily rates, extra activities, and accrued trophy fees must be settled in full prior to departure from the safari grounds.
3.3 Cancellation Policies and Refund Structures
Operating a highly specialized wilderness outfitting service requires intensive forward-planning, block booking of lodges, and the exclusive allocation of professional guides. Therefore, our cancellation parameters are strictly enforced:
Cancellations made more than 180 days prior to the scheduled arrival date will receive a partial refund of the deposit, minus a 15% administrative and booking fee.
Cancellations submitted between 90 and 180 days prior to arrival forfeit 50% of the initial deposit.
Cancellations occurring less than 90 days prior to the scheduled safari start date result in the total forfeiture of the entire deposit.
No refunds or adjustments will be issued for late arrivals, early departures, or unused portions of a safari itinerary due to personal choice, travel delays, or external logistical complications.
4. Hunting Rules, Regulations, and Ethical Standards
4.1 Strict Adherence to Field Commands
The wilderness areas of South Africa contain inherently dangerous apex predators and large game species. For your personal safety and the security of our tracking teams, clients must strictly obey every single instruction, command, and safety directive issued by their designated Professional Hunter (PH) at all times. The PH maintains absolute authority in the field, on the tracking vehicle, and inside the hunting blocks. Failure to follow direct safety commands grants Deon Burger Safaris the right to terminate the safari immediately without refund.
4.2 Legality and Conservation Permits
All hunting activities are conducted strictly in accordance with provincial nature conservation acts, the South African Department of Forestry, Fisheries and the Environment (DFFE) mandates, and fair-chase ethical hunting principles. We do not engage in or tolerate any illegal tracking practices. Deon Burger Safaris manages the acquisition of all necessary hunting licenses and conservation permits based on the information you provide; however, clients must guarantee that all background information supplied is completely accurate and legally valid.
4.3 The Wounding Policy
In alignment with standard international outfitting practices and South African hunting ethics, any animal that is shot at and wounded, showing signs of blood, bone, or tissue damage, is considered a harvested animal. If an animal is wounded, the client is legally and contractually obligated to pay the full trophy fee for that specific species as detailed on the price list. Our Professional Hunters, trackers, and trailing hounds will make every reasonable, exhaustive effort to track down and humanely recover the wounded game, but the fee remains due regardless of whether the physical carcass is retrieved.
5. Firearms, Ammunition, and Temporary Importation
5.1 Compliance with the Firearms Control Act
The temporary importation of hunting rifles into the Republic of South Africa is strictly governed by the Firearms Control Act (Act 60 of 2000). Clients bringing personal firearms must strictly comply with all South African Police Service (SAPS) border regulations. This includes completing the SAPS 520 form, maintaining valid proof of ownership from your home country (such as the US Customs Form 4457 or a European firearms pass), and possessing a formal, verified letter of invitation from Deon Burger Safaris.
5.2 Safe Handling and Storage Protocols
While staying at our hunting properties or traveling between concessions, all firearms must be handled with extreme care and absolute safety. Rifles must remain completely unloaded with actions open at all times when inside transport vehicles or within the main lodge boundaries. When firearms are not active in the field under the direct supervision of your PH, they must be stored locked inside the camp’s designated firearms safe.
5.3 Rifle Hire and Ammunition Charges
For clients who prefer not to travel internationally with personal firearms, Deon Burger Safaris offers high-quality hunting rifles for hire at a flat daily rate of €30 per day. Ammunition consumed during target practice, sighting-in sessions, and field stalks will be billed separately on your final invoice based on current market retail pricing. Clients utilizing hired rifles are fully liable for any negligent structural damage caused to the firearm during their stay.
6. Deep-Sea Fishing Charter Protocols
6.1 Marine Authority and Vessel Safety
All deep-sea fishing charters operating off the coast of KwaZulu-Natal are subject to the strict regulations of the South African Maritime Safety Authority (SAMSA). The skipper of our marine vessel possesses total, absolute authority over the watercraft, crew, and passengers. If weather conditions, ocean swells, or mechanical anomalies pose a risk to human life, the skipper retains the sole right to cancel, shorten, or alter the fishing excursion.
6.2 Catch Limits and Marine Conservation
Our marine operations operate in full compliance with the Marine Living Resources Act. We enforce a strict catch-and-release policy for all billfish species, including marlin and sailfish, ensuring these magnificent pelagic predators are safely revived alongside the hull before release. Edible game fish, such as yellowfin tuna, dorado, and couta, are subject to strict daily bag limits and size restrictions. Any fish retained will be managed responsibly in accordance with local maritime laws.
7. Trophy Care, Taxidermy, and Export Logistics
7.1 Field Preparation Responsibilities
Deon Burger Safaris provides professional field preparation, skinning, caping, and salting of your hunting trophies as part of our all-inclusive daily rates. We guarantee that our skinning teams utilize standard, proven anatomical methods to preserve the quality of your hides and horns. Once the raw trophies are properly salted, cured, and dried in our ventilated storage facilities, our direct operational responsibility concludes.
7.2 Independent Taxidermy and Shipping Third Parties
The final dipping, packing, taxidermy mounting, international insurance, and shipping of your wildlife trophies are handled entirely by independent, third-party taxidermists and global freight forwarding agents. Deon Burger Safaris is not a party to any contract established between the client and the chosen taxidermy studio or shipping firm. Consequently, we accept no legal liability or financial responsibility for trophy damage, hair slip, processing delays, loss in transit, or import/export permitting complications arising once the raw trophies have been signed out of our camp facilities.
8. Medical Disclosures, Physical Fitness, and Insurance
8.1 Mandatory Health Disclosures
Clients are contractually required to inform Deon Burger Safaris in writing of any pre-existing medical conditions, severe physical limitations, cardiac issues, chronic illnesses, or life-threatening food allergies prior to arriving in South Africa. Our remote tracking camps and deep-sea vessels operate far from advanced urban medical centers, making immediate accurate health disclosures vital for your safe care.
8.2 Comprehensive Travel and Medical Insurance Requirements
Because of the inherent risks of wilderness travel, remote geographic tracking, and offshore angling, all clients must secure comprehensive international travel insurance, medical evacuation coverage, and trip cancellation insurance before departing their home country. Your insurance policy must specifically cover adventure sports, hunting activities, and emergency helicopter evacuation within South Africa. Deon Burger Safaris will not be held liable for covering emergency medical bills, hospital stays, or repatriation costs.
9. Assumption of Risk, Indemnity, and Liability Waivers
9.1 Voluntary Assumption of Inherent Wilderness Risks
The client explicitly acknowledges that participating in big game hunting safaris, dangerous game tracking, marine angling charters, and open-vehicle wildlife tours carries inherent, significant risks of personal injury, severe illness, psychological trauma, permanent disability, or death. Wild animals are unpredictable and dangerous; the African bushveld features rugged terrain and venomous reptiles; and deep-sea environments present risks of capsizing, drowning, and extreme weather. By booking our services, you confirm that you choose to enter these environments entirely at your own risk.
9.2 Complete Indemnification of the Outfitter
To the maximum extent permitted under South African law, the client hereby holds harmless, defends, and completely indemnifies Deon Burger Safaris, its owners, directors, professional hunters, skippers, guides, trackers, and associated land-owning concessions against any and all legal actions, claims, demands, liabilities, losses, costs, or court judgements. This indemnity covers any loss or damage to personal property, firearms, camera gear, or baggage, as well as any personal bodily injury, medical crisis, or death arising directly or indirectly from your presence on our safaris.
9.3 Execution of Physical Liability Waivers
Upon arrival at our main hunting lodge or prior to boarding our marine vessels, all guests are required to sign a comprehensive, physical Indemnity and Liability Waiver Form. Refusal to sign this legal document upon arrival will result in the immediate cancellation of your entire safari package without any refund or financial compensation.
10. Intellectual Property, Photography, and Media Rights
10.1 Use of Field Media for Promotional Purposing
During your safari, fishing trip, or regional tour, our staff or professional guides regularly capture digital photographs and high-definition video footage of successful harvests, marine catches, campfire settings, and camp activities. Deon Burger Safaris reserves the right to utilize these media elements for promotional materials, social media networks, print brochures, and website imagery.
10.2 Client Privacy Rights and Opt-Out Clauses
We respect your personal privacy. If you prefer that your name, image, or trophy photos remain entirely confidential and excluded from our marketing platforms, you must explicitly notify us in writing before your safari begins. In the absence of a formal written opt-out notice, you grant our business an unrestricted, royalty-free, perpetual license to use your safari media for promotional purposes.
11. Breach of Contract and Force Majeure
11.1 Consequences of Material Breach
Any failure by a client to adhere to the payment schedules, safety rules, firearm storage laws, or ethical codes detailed within these Terms and Conditions constitutes a material breach of contract. In the event of a breach, Deon Burger Safaris reserves the explicit right to cancel your itinerary immediately, expel you from the tracking concessions, and pursue full legal financial compensation in South African courts.
11.2 Force Majeure Exclusions
Deon Burger Safaris will not be held legally responsible or financially liable for any failure, delay, or disruption in fulfilling our safari commitments caused by a Force Majeure event. Force Majeure encompasses occurrences entirely beyond our reasonable control, including but not limited to: acts of God, sudden civil unrest, military actions, national political strikes, government border closures, wildlife disease outbreaks, pandemics, severe climatic weather disasters, international flight groundings, or sudden regulatory shifts in nature conservation laws.

If any specific clause or sub-section within this text is declared invalid or unenforceable by a South African court of law, that specific provision will be severed, while the remaining clauses will retain full legal force and validity.
